Ethical decision-making frameworks assist in identifying the issues at stake in a particular setting and thinking through, in a methodical manner, the ethical issues that require consideration as well as the values that need to be considered and promoted. Decisions made about the use, sharing, and re-use of big data are complex and laden with values. This paper sets out an Ethics Framework for Big Data in Health and Research developed by a working group convened by the Science, Health and (...) Policy-relevant Ethics in Singapore Initiative. It presents the aim and rationale for this framework supported by the underlying ethical concerns that relate to all health and research contexts. It also describes a set of substantive and procedural values that can be weighed up in addressing these concerns, and a step-by-step process for identifying, considering, and resolving the ethical issues arising from big data uses in health and research. This Framework is subsequently applied in the papers published in this Special Issue. These papers each address one of six domains where big data is currently employed: openness in big data and data repositories, precision medicine and big data, real-world data to generate evidence about healthcare interventions, AI-assisted decision-making in healthcare, public-private partnerships in healthcare and research, and cross-sectoral big data. Thông qua dữ liệu khảo sát đối với 310 khách hàng trẻ tuổi tại Hà Nội, bài viết tập trung vào việc nghiên cứu những yếu tố tác động đến ý định mua lại mỹ phẩm của khách hàng trẻ tuổi tại Hà Nội thông qua việc xác định các yếu tố ảnh hưởng đến sự hài lòng – yếu tố trung gian tác động đến ý định mua lại. Kết quả nghiên cứu đã chỉ ra, có 4 yếu tố (...) của chất lượng dịch vụ sàn thương mại điện tử (TMĐT) tác động tới sự hài lòng của khách hàng là: Dịch vụ khách hàng, Thực hiện đơn hàng, Thiết kế website và Tính bảo mật. In this paper, I take up one of Wang Yangming’s most audacious philosophical claims, which is that an achievement that is entirely concerned with correcting one’s own inner states, called “establishing sincerity” (licheng 立誠) can help one to fully grasp (jin 盡) all ethically pertinent matters, including those that would seem to require some ability to know or track facts about the wider world (e.g., facts about people very different from ourselves, facts about the needs of plants and animals). Wang (...) makes a claim to this effect in some of his letters and recorded discussions. -/- I begin with a brief, historical reconstruction of what Wang means by “establishing sincerity” and then turn to two sets of controversies regarding his audacious claim. The first has to do with how we should understand the proposal that establishing sincerity helps or positions a person to fully grasp all ethically significant concerns. On the interpretation of Chen Lai 陳來, Wang doesn’t think that establishing sincerity is sufficient by itself to have this grasp, only that it lays a necessary psychological foundation for all attempts to do so, so that it leaves much more work to do. I largely agree with Chen’s reading but find it isn’t strong enough to capture what’s most important and controversial about Wang’s view. On my stronger reading, Wang doesn’t just think that establishing sincerity provides a necessary foundation for a complete grasp, he also thinks that it describes the most difficult and demanding step or part of the process – the other steps come much more naturally and easily. The second set of controversies has to do with whether we can preserve Wang’s core account of virtuous moral agency without his strong ethical nativism, according to which we have an inherent capacity and disposition to track what is ethically important or salient about people and things very much unlike ourselves. I consider some arguments and interpretations of Wang’s thought that might allow us to bypass his nativist presuppositions, and conclude that they do not succeed. Even if we cannot accept his ethical nativism, however, there is a range of important ethical norms for which Wang’s prescriptions are powerful and prudent. The result of this study, I hope, will be an account of Wang’s thought which better positions us to see what parts are (and are not) worth bringing to ongoing debates about the nature of ethics, moral knowledge, and moral virtue. The cicada catcher focuses as much on technique as he does on outcomes. In response to Confucius’ question, he articulates in detail the learning he has undertaken to develop techniques at each level of competence. This chapter explains the connection between the cicada catcher’s development of technique and his orientation toward outcomes. It uses details in this story to contribute to recent discussions in epistemology on the cultivation of technique.

A prominent way of justifying civil disobedience is to postulate a pro tanto duty to obey the law and to argue that the considerations that ground this duty sometimes justify forms of civil disobedience. However, this view entails that certain kinds of uncivil disobedience are also justified. Thus, either a) civil disobedience is never justified or b) uncivil disobedience is sometimes justified. Since a) is implausible, we should accept b). I respond to the objection that this ignores the fact that (...) civil disobedience enjoys a special normative status on account of instantiating certain special features: nonviolence, publicity, the acceptance of legal consequences, and conscientiousness. I then show that my view is superior to two rivals: the view that we should expand the notion of civility and that civil disobedience, expansively construed, is uniquely appropriate; and the view that uncivil disobedience is justifiable in but only in unfavorable conditions. Social movements often impose nontrivial costs on others against their wills. Civil disobedience is no exception. How can social movements in general, and civil disobedience in particular, be justifiable despite this apparent wrong-making feature? We examine an intuitively plausible account—it is fair that everyone should bear the burdens of tackling injustice. We extend this fairness-based argument for civil disobedience to defend some acts of uncivil disobedience. Focusing on uncivil environmental activism—such as ecotage (sabotage with the aim of protecting the environment)—we (...) argue that some acts of uncivil disobedience can be morally superior to their civil counterparts, when and because such acts target people who are responsible for environmental threats. Indeed, insofar as some acts of uncivil disobedience can more accurately target responsible people, they can better satisfy the demands of fairness compared to their civil counterparts. In some circumstances, our argument may require activists to engage in uncivil disobedienceeven whencivil disobedience is available. (shrink)

A distinguishing characteristic of Confucianism is its emphasis on learning (xue), is a key element in moral self cultivation. This paper discusses why learning from the experiences of those in the past is important in Confucian learning.

Tainted political symbols ought to be confronted, removed, or at least recontextualized. Despite the best efforts to achieve this, however, official actions on tainted symbols often fail to take place. In such cases, I argue that political vandalism—the unauthorized defacement, destruction, or removal of political symbols—may be morally permissible or even obligatory. This is when, and insofar as, political vandalism serves as fitting counter-speech that undermines the authority of tainted symbols in ways that match their publicity, refuses to let them (...) speak in our name, and challenges the derogatory messages expressed through a mechanism I call derogatory pedestalling: the glorification or honoring of certain individuals or ideologies that can only make sense when members of a targeted group are taken to be inferior. Many have argued that certain statues or monuments are objectionable, and thus ought to be removed. Even if their arguments are compelling, a major obstacle is the apparent historical value of those commemorations. Preservation in some form seems to be the best way to respect the value of commemorations as connections to the past or opportunities to learn important historical lessons. Against this, I argue that we have exaggerated the historical value of objectionable commemorations. Sometimes commemorations connect to biased or (...) distorted versions of history, if not mere myths. We can also learn historical lessons through what I call repudiatory honouring: the honouring of certain victims or resistors that can only make sense if the oppressor(s) or target(s) of resistance are deemed unjust, where no part of the original objectionable commemorations is preserved. This type of commemorative practice can even help to overcome some of the obstacles objectionable commemorations pose against properly connecting to the past. (shrink)

This paper explores the contribution of early Daoist thought to contemporary feminist philosophy. It has often been noted that the Daodejing stands in contrast to other texts of the same period in its positive evaluation of femininity and of values associated with the feminine. This paper takes a cautious approach to the Daoist concept of the feminine, noting in particular its emphasis on the characteristic of feminine submissiveness. On the other hand, the paper seeks to demonstrate that the Daoist treatment (...) of contrastive pairs--in particular, the Daoist notion of complementarity--provides a powerful conceptual scheme within which the notions of both femininity and masculinity may be articulated. Lachlan Umbers defends democracy against Jason’s Brennan’s competence objection, by showing that voting even incompetently does not violate the rights of others, as the risk imposed is negligible, and furthermore lower than other permissible actions, e.g. driving. I show there are costs in taking this line of argument. Accepting it would make arguing for the duty to vote more difficult in two ways: since voting incompetently is permissible, and not voting imposes less risk than not voting, then not voting is (...) permissible; in terms of fairness, voting incompetently is worse than not voting, if voting incompetently is permissible, then there cannot be a fairness-based duty to vote. The Zhuangzi, a 4th century BCE Chinese text, is optimistic about life unrestrained by entrenched values. This paper contributes to existing debates on Zhuangzian freedom in three ways. First, it reflects on how it is possible to enjoy the freedom envisaged in the Zhuangzi. Many discussions welcome the Zhuangzi’s picture of release from life shaped by canonical visions, without also giving thought to life without these driving visions. Consider this scenario: in a world with limitless possibilities, would it not be (...) fraught, not knowing how to interpret situations? I suggest that freedom in the Zhuangzi is possible only if one succeeds in reorienting herself to the new ‘normal’. Second, I introduce and develop the idea of working with constraints. This focuses on an agent's maximizing the fit between relevant conditions, on the one hand, and their capabilities, on the other. Finally, I propose that self-directed practice, an important expression of agency, is required for building capabilities that enable such freedom. I examine the idea of risk involved in these firsthand experiences, articulating an account of agency that sits at the heart of hard-won Zhuangzian freedom. (shrink)

Civil disobedience, despite its illegal nature, can sometimes be justified vis-à-vis the duty to obey the law, and, arguably, is thereby not liable to legal punishment. However, adhering to the demands of justice and refraining from punishing justified civil disobedience may lead to a highly problematic theoretical consequence: the debilitation of civil disobedience. This is because, according to the novel analysis I propose, civil disobedience primarily functions as a costly social signal. It is effective by being reliable, reliable by being (...) costly, and costly primarily by being punished. My analysis will highlight a distinctive feature of civil disobedience: civil disobedients leverage the punitive injustice they suffer to amplify their communicative force. This will lead to two paradoxical implications. First, the instability of the moral status of both civil disobedience and its punishment to the extent where the state may be left with no permissible course of action with regard to punishing civil disobedience. Second, by refraining from punishing justified civil disobedience, the state may render uncivil disobedience—illegal political activities that fall short of the standards of civil disobedience—potentially permissible. In the Lunyu, Confucius remarks on the implausibility—or impossibility—of a life lacking in xin 信, reliability (2.22). In existing discussions of Confucian philosophy, this aspect of life is often eclipsed by greater emphasis on Confucian values such as ren 仁 (benevolence), li 禮 (propriety) and yi 義 (rightness). My discussion addresses this imbalance by focusing on reliability, extending current debates in two ways. First, it proposes that the common translation of xin as denoting coherence between a person’s words and deeds (...) is inadequate. The translation fails to capture the longer-term consistency in a person’s actions and behaviours in different circumstances across time. Second, it explores how the Lunyu passages discuss the processes of learning that prepare a person for reliable action. (shrink)

Discussions of human partiality—anthropocentrism—in the literature in environmental ethics have sought to locate reasons for unnecessary and thoughtless degradation of the earth’s environment. Many of the debates have focused on metaethical issues, attempting to set out the values appropriate for an environmental ethic not constrained within an anthropocentric framework. In this essay, I propose that the fundamental problem with anthropocentrism arises when it is assumed that that is the only meaningful evaluative perspective. I draw on ideas in the Zhuangzi, a (...) classical Chinese philosophical text of the Daoist tradition. The Zhuangzi scrutinises the debates of its day, focusing on the attitudes of the thinkers who sought to trump others in the debates. Through many images expressed in stories, the Zhuangzi asserts the irreducibility of individual perspectives, challenging its readers to examine the insularity of their own views. I suggest that the epistemological awareness in the Zhuangzi helps in our understanding of anthropocentrism. (shrink)

Mengzi maintained that both benevolence (ren 仁) and rightness (yi 義) are naturally-given in human nature. This view has occupied a dominant place in Confucian intellectual history. In Mencius 6A, Mengzi's interlocutor, Gaozi, contests this view, arguing that rightness is determined by (doing what is fitting, in line with) external circumstances. I discuss here some passages from the excavated Guodian texts, which lend weight to Gaozi's view. The texts reveal nuanced considerations of relational proximity and its limits, setting up requirements (...) for moral action in scenarios where relational ties do not play a motivational role. I set out yi's complexity in these discussions, highlighting its implications for (i) the nei-wai debate; (ii) the notion of yi as "rightness," or doing the right thing; and (iii) how we can understand the connection between virtue and right action in these early Confucian debates. This material from the excavated texts not only provides new perspectives on a longstanding investigation of human nature and morality, it also challenges prevailing views on Warring States Confucian intellectual history. In the well-known debate between Mengzi and Gaozi in Mencius 6A, Mengzi maintained that both ren and yi are naturally-given 1 in human nature. This study examines the effects of ownership structure on firm performance in the Vietnamese stock market using a sample of 76 manufacturing companies listed on the Ho Chi Minh Stock Exchange (HOSE) during 2007-2015. Firm performance is measured by Tobin’s Q, and ownership structure is investigated in three different aspects: managerial ownership, block ownership and state ownership.

This chapter discusses ren 仁, a major term in the Confucian Analects. It analyzes the range of meanings of ren across different conversations, paying special attention to its associations with other key Confucian terms such as li (禮 behavioural propriety) and zhi (知 understanding). Building on this analysis, the discussion focuses on ren in terms of how it is manifest in a person’s life. In particular, it expresses ren in terms of an exemplary life—a life lived well. Relationships with international students can be beneficial to higher education in terms of financial and human resources. For this reason, establishing and maintaining such relationships are usually pre-eminent concerns. In this study, we extended the application of the disconfirmation expectation model by incorporating components from subjective task value to predict the loyalty of international students toward their host countries. On a sample of 410 Vietnamese students enrolled in establishments of higher education in over 15 countries across the globe, we employed (...) structural equation model to construct the conceptual model. Our empirical findings revealed that while the roles of satisfaction and disconfirmation are still important as direct and indirect antecedents of international student loyalty, its most powerful predictors are the three components of subjective task value: attainment, utility and intrinsic. These insights result in a number of implications for actors on the higher ducation scene, such as heads of institutions and policy makers. (shrink)

Since the 1940s, Western epistemology has discussed Gilbert Ryle’s distinction between knowledge-that and knowledge-how. Ryle argued that intelligent actions – manifestations of knowledge-how – are not constituted as intelligent by the guiding intervention of knowledge-that: knowledge-how is not a kind of knowledge-that; we must understand knowledge-how in independent terms. Yet which independent terms are needed? In this chapter, we consider whether an understanding of intelligent action must include talk of knowledge-to. This is the knowledge to do this or that now, (...) not then or in general. Our argument is refined and buttressed by consideration of a text in Chinese philosophy, the Lüshi Chunqiu. This 3rd century BCE text, a compendium on good government, focuses on different types of knowledge that an effective ruler or a capable official should possess. A significant number of those discussions concern examples of knowing-how being manifested in particular situations. The text is explicitly aware of the importance of timeliness and awareness of context in manifesting know-how. Some might say that these are merely manifestations of knowing-how. But we see these examples as revealing characteristics of know-how that Ryle did not anticipate. Might knowing-to be an essential and irreducible aspect of intelligent action? (shrink)

The standard criticisms of Confucian ethics appear contradictory. On the one hand, Confucian ethics is deemed overly rule-bound: it is obsolete because it advocates adherence to ancient Chinese norms of proper conduct. On the other hand, Confucian ethics is perceived as situational ethics—done on the run—and not properly grounded in fundamental principles or norms. I give reasons for these disparate views of Confucian ethics. I also sketch an account of Confucian morality that focuses on moral development; in this account the (...) place of normative ethics is nominal. (shrink)

Plagiarism, which Indiana University’s Writing Tutorial Service defines as "using others' ideas and words without clearly acknowledging the source of that information", is often described as a major problem. However, standard definitions such as this one suggest only limited solutions to the problem: acknowledging sources or forbidding reuse. Since all scholarship involves engaging with the ideas of others and academic writing tends to reuse certain expressions, these solutions – though important – are of limited utility. This paper examines a type (...) of plagiarism to which the standard solutions do not apply: the reuse of linguistic models without sufficient attention to the logic or thoughts the texts express. We present two cases of plagiarism, from which we can see that plagiarism shows a gap between the written texts and the thoughts of the author. In order to fill the gap, one needs to know how to integrate not only the texts borrowed from others into one’s writing but also the thoughts expressed by the texts. I think Tongdong Bai's Confucian Meritocracy requires a lot of idealisation. Feasibility aside, should we realise the conditions for Confucian Meritocracy to work, we would have created the ideal situation for democracy to function properly. This challenges the purported advantages Confucian Meritocracy enjoys over democracy.

The term, "objectionable commemorations”, refers to a broad category of public artefacts – such as, and especially, memorials, monuments and statues – that are regarded as morally problematic in virtue of what or whom they honour. In this regard, they are a special class of public artefacts that are subject to public contestation. In this paper, we survey the general ethical and political issues on this topic. First, we categorise the arguments on offer in the literature, concerning the objectionable nature (...) of such commemorations. Second, we review common political responses to objectionable commemorations. Finally, we identify fruitful areas for further philosophical inquiry on this topic. (shrink)

The Routledge Companion to Virtue Ethics, edited by Lorraine Besser-Jones and Michael Slote, is unusual among the recent crop of handbooks, encyclopedias, and compendiums in philosophy in a couple of respects. Experience, it is widely agreed, constrains our thinking and is also thoroughly theory-laden. But how can it constrain our thinking while depending on what it purports to constrain? To address this issue, I revisit and carefully analyze the account of observation provided by Norwood Russell Hanson, who introduced the term ‘theory-ladenness of observation’ in the first place. I show that Hanson’s account provides an original and coherent response to the initial question and argue that, if suitably developed, his account provides (...) a distinctive, powerful, and attractive alternative to relationalist and standard representationalist conceptions of experience. It has been a common assumption that words are substances that instantiate or have properties. In this paper, I question the assumption that our ontology of words requires posting substances by outlining a bundle theory of words, wherein words are bundles of various sorts of properties (such as semantic, phonetic, orthographic, and grammatical properties). I argue that this view can better account for certain phenomena than substance theories, is ontologically more parsimonious, and coheres with claims in linguistics.

One of the main contentions of the framework for Responsible Innovation (RI) is that social and ethical aspects have to be addressed by deliberative engagement with stakeholders and the wider public throughout the innovation process. The aim of this article is to reflect on the question to what extent is deliberative engagement suitable for conducting RI in business. We discuss several tensions that arise when this framework is applied in the business context. Further, we analyse the place of deliberative engagement (...) in several theories of business ethics. We conclude that there remains a tension between the ideal of RI and the way in which the competitive market operates. Hence, RI scholars should reflect more critically on changes that are required in the market in order to make RI possible, modify the ideal of deliberative engagement for RI in business, or attempt to strike a balance between these two responses. Delmas successfully guides us to reconsider the traditional “wisdom” of civil disobedience. She also makes a strong case for expanding the notion of political obligation, which has been narrowly construed as mere obedience, to encompass a duty to resist. Principled disobedience, either civil or uncivil, includes a wide range of tools to tackle different forms of injustice, such as education campaigns, peaceful protests, graffiti street art, whistleblowing, vigilante self-defense, and political riots. We may question to what extent the violent disobedience (...) can be justified, as it is always good to be careful about violence that risks harming the innocent, but other forms of civil or uncivil disobedience may rightly be demanded in realistic circumstances. As I see it, these, along with the general warning to not unwittingly serve the status quo by dismissing social movements merely because of “incivility” and the proposal of the civic virtues of vigilance and open-mindedness, are significant contributions to the literature and could also benefit a politically interested general audience greatly. The theory of science that Thomas Kuhn built in the Structure of Scientific Revolutions was considered as a hypothetical framework in this study. Since the publication of the work, many questions have arisen that call for a psychology of science. These questions are moved to another dimension through the knowledge of the decision made within Galileo Affair, which occupies an important place in modern science, fundamentally arising from an epistemic struggle and emerging out of an unscientific base rather than the (...) charge of unholiness. Abandoning the perspective which evaluates these questions within a historical process as a weak side of the Kuhnian theory of science, this study challenges the current approaches with an alternative approach. The epistemic complexity in the Kuhnian theory of science is an imperative complexity caused by human factors. From this perspective, there are potential questions for psychology of science as a field of study based on Kuhnian epistemology and it can be assumed that new problems may appear when the other epistemological questions which assumed as “answered” are reviewed in the scope of this study. The main thesis of this study is that psychology of science is possible as a valid and operationalizable research program based on Kuhnian theory of science. (shrink)

In the Tractatus Theologico-Politicus (TTP), Spinoza argues that an individual’s natural right extends as far as their power. Subsequently, in the Tractatus Politicus (TP), he offers a revised argument for the same conclusion. Here I offer an account of the reasons for the revision. In both arguments, an individual’s natural right derives from God’s natural right. However, the TTP argument hinges on the claim that each individual is part of the whole of nature (totius naturae), and for this reason inherits (...) part of the natural right of that whole. Using several analogous cases from the Ethics, I show that this form of argument from division is not compatible with Spinoza’s considered metaphysical views. The revised argument, by contrast, avoids the pitfalls of his earlier efforts. It also better reveals the deep roots by which the monistic metaphysics of the Ethics feeds into Spinoza’s conception of natural right. (shrink)

Can an ugly experiment be a good experiment? Philosophers have identified many beautiful experiments and explored ways in which their beauty might be connected to their epistemic value. In contrast, the present chapter seeks out (and celebrates) ugly experiments. Among the ugliest are those being designed by AI algorithms. Interestingly, in the contexts where such experiments tend to be deployed, low aesthetic value correlates with high epistemic value. In other words, ugly experiments can be good. Given this, we should conclude (...) that beauty is not generally necessary or sufficient for epistemic value, and increasing beauty will not generally tend to increase epistemic value. (shrink)

A number of philosophers think that grounding is, in some sense, well-founded. This thesis, however, is not always articulated precisely, nor is there a consensus in the literature as to how it should be characterized. In what follows, I consider several principles that one might have in mind when asserting that grounding is well-founded, and I argue that one of these principles, which I call ‘full foundations’, best captures the relevant claim. My argument is by the process of elimination. For (...) each of the inadequate principles, I illustrate its inadequacy by showing either that it excludes cases that should not be ruled out by a well-foundedness axiom for grounding, or that it admits cases that should be ruled out. How are love and justice related? Iris Murdoch characterizes the former by drawing on the latter. Love, she maintains, is just attention, which in turn triggers acts of compassion. Arguably, for Murdoch, love is the most important moral activity. By engaging in love, she maintains, moral agents progress on their journey from appearances to reality. Through love, they overcome selfish leanings, acquire a clearer vision of the world and, importantly, other individuals, which in turn enables them to act increasingly well. (...) In this paper, I lay Murdoch’s account of love alongside of Aristotle’s notion of philia. Ultimately, I argue that both Murdochian love and Aristotelian philia are crucial for enabling moral progress. I proceed as follows: First, I introduce Murdoch’s view. I then propose a novel reading of an argument from Aristotle’s Nicomachean Ethics in order to explain what I shall call his necessity claim (NC): philia is necessary to a flourishing life. Along the way, I point out ways in which Murdoch’s and Aristotle’s accounts are mutually illuminating. (shrink)

Dieser Artikel enthält eine kritische Diskussion der von Peter Stemmer in seinem Buch "Normativität. Eine ontologische Untersuchung" vorgelegten Analyse von Normativität. Zentraler Kritikpunkt ist der Umstand, dass der für Stemmers Analyse zentrale Begriff des Wollens unanalysiert bleibt, sich dieses jedoch, so das hier vorgestellte Argument, entweder in einer Weise analysieren lassen wird, die, als Tendenz gedeutet, weniger zu leisten vermag als Stemmer für seine Analyse benötigt, oder, als intentionaler Zustand gedeutet, selbst bereits Normativität voraussetzt und somit für Stemmers reduktive Analyse (...) von Normativität nicht geeignet ist. Gegen Ende des Aufsatzes wird eine pragmatistische Fundierung von Normativität angedeutet und verschiedene Ressourcen aufgezeigt, deren sich Stemmer bedienen könnte, um seine Position gegen die vorgebrachten Einwände zu verteidigen.
